Introduction

There are two parts to these Terms and Conditions. The general T&C's are first, with the T&C'S relating to DNA Keepsake Jewellery coming second.

 

These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Rejewelled, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately. By placing an order with us, you agree to the Terms and Conditions outlined here.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Rejewelled and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Rejewelled and accessing the Website in connection with the provision of such services.

You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

Intellectual property and acceptable use

  1. All Content included on the Website, unless uploaded by Users, is the property of Rejewelled, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission
  2. You may, for your own personal, non-commercial use only, do the following:
    1. retrieve, display and view the Content on a computer screen
  3. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Rejewelled.

Prohibited use

  1. You may not use the Website for any of the following purposes:
    1. in any way which causes, or may cause, damage to the Website or interferes with any other person's use or enjoyment of the Website;
    2. in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law, regulation, governmental order;
    3. making, transmitting or storing electronic copies of Content protected by copyright without the permission of the owner.

Availability of the Website and disclaimers

  1. Any online facilities, tools, services or information that Rejewelled makes available through the Website (the Service) is provided "as is" and on an "as available" basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. Rejewelled Jewellery is under no obligation to update information on the Website.
  2. Whilst Rejewelled uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.
  3. Rejewelled accepts no liability for any disruption or non-availability of the Website.
  4. Rejewelled reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

Limitation of liability

  1. Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.
  2. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.
  3. To the maximum extent permitted by law, Rejewelled accepts no liability for any of the following:
    1. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
    2. loss or corruption of any data, database or software;
    3. any special, indirect or consequential loss or damage.

General

  1. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.
  2. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.
  3. These terms and conditions together with the Privacy Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.
  4. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.
  5. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.
  6. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
  7. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Specifics to DNA Keepsake Jewellery

LEAD TIMES

Our ESTIMATED lead time from receipt of inclusions is 16-20 weeks. This time is needed for us to handcraft your jewellery and for us to professionally preserve your inclusions. This estimated time may be subject to change without warning due to situations beyond our control. We will post updates to social media if our lead times are extended far beyond those quoted. 

 

RETURNS

If we agree to a return, the item must be sent back to us within 30 days, in the same condition that you recieved it and in the original packaging with any literature and free items that may have been included. Do not return an item without prior agreement as we will not refund or replace.

We strongly suggest that items are sent via an insured and tracked service as we cannot be held responsible for the item until it is back in our studio.

All jewellery is custom made by hand, therefore there are no refunds or exchanges given for change of mind or differences in the design or the way in which the inclusions or additions have settled within the resin.  Please check all details listed with the item before placing your order. We reserve the right to judge our own quality and we do our absolute best to send out to you the highest quality pieces. Our items are however handmade, and it is normal to have micro airbubbles in resin, or small making marks on the metal.

From time to time we offer 'tester' designs, where we offer a new design at a reduced rate so that we can test it out. As these pieces are new, we may occasionally find a design flaw that needs changing/fixing or our customers may notice an issue that needs addressing. We will not offer refunds on these pieces but will instead remake/rework the item as often as necessary until we are happy with the item.

If a piece of jewellery arrives damaged or broken, please contact us within 5 working days so that we can try to rectify this for you. Please note that we photograph items before they leave our studio for insurance purposes.

If there is an error on our part such as a spelling mistake on a customised piece we will replace the item for you. We cannot remake or refund without being in receipt of the original item with the exception of items sent by us that have been lost in the post. You can arrange returns via the Facebook messaging service or by emailing info@rejewelled,co.uk within 5 business days.

 However, Rejewelled will not be held responsible for the following: 

- If a product has been modified, changed or repaired by someone other than Rejewelled.

- Any faults or defects from wear and tear or lack of proper care and cleaning.

- Any defects resulting from neglect, accidental damage or misuse

- Any irregularities in the settlement of inclusions within the resin. This includes any colour, glitters or shimmers.

 

COMMISSIONS:

 Please ensure that when placing an order for a commissioned piece that you double check all details as mistakes cannot often be rectified once the 
piece has started to be made. If you realise that you have made a mistake once work has started, then Rejewelled accepts no liability for this and any costs 
for the remaking will be incurred by the customer. However, we will do our very best to work with you and help if we can.  
  
If we agree to a return, the item must be sent back to us within 30 days, in the same condition that you received it and in the original packaging with any literature and free items that may have been included.

INCLUSIONS:

Do not send us the last of any inclusion. Even if you only have a tiny amount of milk/hair/ashes, keep half and send us the other half, even if it means sending less than we've asked for. We cannot be held responsible for any inclusions lost in the post. We will email you when your inclusions arrive but due to covid and our quarantine procedures, you may not hear from us for a couple of weeks. Please refrain from emailing until at least two weeks has passed.

We will send back any leftover ashes along with your order. We will also send back any left over umbilical cord, fabric, flowers if possible.

Leftover breastmilk will not be returned as it will have been professionally preserved and due to the processes and chemicals used, it is not safe for us to return it to you and goes against our insurance. However, we will keep it 'on file' for at least 12 months after shipping your order, so if you'd like to order again using this milk, please let us know.

If you have requested an inclusion posting kit, we reserve the right to delay sending the kit during our busier times. This enables us to manage our workload effectively. If you need your order for a particular date, please let us know upon ordering so that we can ensure your kit is sent promptly.

ADDITIONAL NOTES:

Each piece of jewellery is handcrafted using a wide range of materials. Sometimes it can be difficult to match size, colour and shape of the resin and fabrics/other materials exactly to those shown in the images on the website, so please allow for some small variations to the images shown.

 

SHIPPING 

Please note that items sent outside the UK may be subject to import duties, fees and taxes. Any additional fees incurred are the responsibility of the customer. If you are unsure, we recommend that you contact the appropriate authorities prior to purchase. We cannot refund an order if it has been delayed or if you have received import duties.

If Royal Mail leave you a 'red card' to say that they've attempted delivery, it is your responsibility to ensure that you collect it within the time frame given by them. Failure to collect on time will result in it being returned to us and you will be liable to pay us for the additional P&P costs at a rate of £4.95.

 

PROMOTIONAL CODES

Rejewelled may offer promotional codes to regular customers from time to time. Please note that only one promotional code can be used at any one time. We cannot refund any money if you have forgotten to use a discount code.

Please note that customers are responsible for the return shipping costs and these will not be refunded. Rejewelled will not be held responsible for any item until it is safely in our hands.


EXCHANGES

If for any reason you are unhappy with your piece, please contact us within ten days at info@rejewelled.co.uk

We do not offer refunds if you are unhappy with your order, but will instead offer to remake or exchange your order.

 

CHANGES TO YOUR ORDER

If you have not yet posted your inclusions then you can occasionally make minor changes to your order, including colour changes or changing your ring size. Please contact us ASAP if you'd like to discuss any changes, however we cannot guarantee that it'll be possible.

 

CANCELLATION

Once you have placed your order we start making the actual setting. This is custom work and therefore cannot be cancelled after a 24hr period.

We do not allow cancellations or refunds due to our lead time being extended. All lead times are ESTIMATED and are subject to change without notice. We also do not allow cancellations or refunds if you have forgotten to send in your inclusions.

We are not responsible for your inclusions until they're safely in our hands. Please DO NOT send the last of your milk/hair etc as you will be required to send more if the first parcel doesn't arrive. We do not offer refunds on orders for incidences where your inclusions have not arrived. However, we will work with you to alter your design so it can feature different inclusions.

COVID-19

The COVID-19 pandemic is currently causing shipping delays across the UK. Once we email your shopping confirmation it can take up to a week for your item to be processed at the Post Office. This is because our our own protection procedures, including packaging items and leaving them for at least 48 hours to ensure any viruses would be inactive. We are also subject to delays in getting items to the Post Office due to social distancing. Finally, we have no control over how long the Post Office themselves take to process your packages. If, after a month, your order hasn't arrived we will assume the item is lost in the post and with therefore remake it free of charge and will claim back from the Royal Mail.

We offer no refunds because of any delays caused by the COVID-19 pandemic.

RECEIVING PARCELS

Due to the COVID-19 pandemic we may take up to 14 days to email you to say that we have received your inclusions. Please refrain form emailing us about your inclusions until after this 14 day period.

UPDATES

It is impossible for us to update everyone on the status of their orders, during these uncertain times it can take us longer to ship your order due to situations beyond our control. Please refrain from sending weekly emails or posting on our  social media about your orders during this time. Every email or message that we answer means time away from creating your jewellery in our studio. 

DIY KITS

Our new DIY kits are available to order via our website. Jewellery made using these kits user a different process to the professional preservation process that we use in our studio. We are not liable for any user error or any issues arising from the use of these kits or the items made from them.

SENDING INCLUSIONS

During the Coronavirus pandemic we are asking that customers package up their inclusions and then wait 48 hours before posting. This will help to ensure that any viruses on the package are inactive. This is to protect our staff from possible contamination.

Please send your inclusions within TWO MONTHS of ordering. After this time your order will be archived and when you're ready to continue with your order you will be issued with a credit note* for the amount paid. You will be liable to make up any shortfall when you reorder.

*Credit notes are essentially discount codes for the amount you've already paid and as such, they cannot be used alongside any other discount code. This includes our sales where you have to input a code to gain money off/ a free gift etc. This is due to the website software that we use not allowing multiple codes to be used at once.

Please only send inclusions once you have placed your order. Please include a note with any additional information you did not supply during the checkout process. Ensure your name, contact details and order number are included in the parcel.
